1. Purpose of the Document and Applicable Terms

1.1. This document “30-Day Freetest VDS – Special Trial Policy” (the “Special Trial Policy”) establishes the parameters and unique terms of the Trial Programme “30-Day Freetest VDS” (the “Programme”) provided by UAB ServerMall and its affiliates operating under the designation “Servermall Cloud” (collectively, “Servermall Cloud”).

1.2. The Programme is a Trial Programme within the meaning of “Servermall Cloud Trial Policy” (the “Trial Policy”). This Special Trial Policy specifies how the Trial Policy applies to the Programme.

1.3. This Special Trial Policy applies subject to the order of contractual priority established by the Trial Policy. In the event of conflicts between this Special Trial Policy and the Trial Policy with respect to the parameters and procedure for providing the Programme, this Special Trial Policy applies, unless the Individual Trial Programme Agreement, the applicable Contract or mandatory requirements of applicable law provide otherwise. To the extent not regulated by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents apply.

1.4. Descriptions of the Programme in instructions, on the Site, in the interface, in tooltips, banners, the “Questions and Answers” section, advertising and other informational materials do not amend this Special Trial Policy, the Trial Policy or the Agreement and are not an Individual Trial Programme Agreement, unless they expressly show the agreed intention of the Parties to amend the terms of the Programme. In the event of a conflict, the applicable contractual documents have priority in the order established by the Trial Policy.

1.5. The requirements of the Acceptable Use Policy, No Spam Policy, Intellectual Property Policy and other applicable Servermall Cloud documents must be complied with in all cases. If this Special Trial Policy provides requirements that are less strict than those documents, the stricter requirements apply, unless mandatory requirements of applicable law provide otherwise.

2. Main Parameters of the Programme

2.1. The Programme is provided at the discretion of Servermall Cloud and is intended for evaluation of the “Virtual Machines” Service.

2.2. As part of the Programme, Servermall Cloud provides the User with Test Access to the “Virtual Machines” Service.

2.3. Test Access is provided for 30 calendar days. The term is calculated from the date and time of actual deployment of the trial virtual server instance, as recorded in the Servermall Cloud accounting system, and ends after 30 calendar days on the corresponding date and at the corresponding time according to Servermall Cloud billing time. If another time is displayed to the User in the Servermall Cloud interface, the data in the Servermall Cloud accounting system has priority, unless mandatory requirements of applicable law provide otherwise.

2.4. As part of Test Access, the User receives:

  1. a virtual server instance with the configuration and limits established by this Special Trial Policy;
  2. access to the Servermall Cloud control panel for the “Virtual Machines” Service;
  3. access to operating system images;
  4. the ability to deploy applications from the Servermall Cloud application store.

2.5. To implement the purposes of the Programme, Servermall Cloud reflects in the Servermall Cloud accounting system (billing), in relation to the User Account, a Promotional Credit with a nominal value determined by Servermall Cloud as the estimated cost of 30 calendar days of using the configuration and limits of the Test Resources specified in clause 2.7 of this Special Trial Policy (the “Bonus”). The Bonus is a conditional accounting value and is used solely to cover, for accounting purposes, the fixed configuration and limits of the Test Resources as part of the Programme. Reflecting or debiting the Bonus does not constitute the User making Payment, crediting monetary funds to the Account Balance or making Payment for a Paid Subscription, and does not serve as a basis for a refund, payout, withdrawal or compensation. The Bonus may not be used for other Services, changing the configuration, expanding limits, making Payment for a Paid Subscription after the end of Test Access or withdrawing funds.

2.6. Withdrawal of the Bonus and any other use of the Bonus not provided for by this Special Trial Policy are prohibited.

2.7. Configuration and limits of the Test Resources for Test Access:

  1. 2 vCPU with dedicated vCPU resources (100%);
  2. 4 GB RAM;
  3. 75 GB All-Flash Storage (SSD);
  4. 5 TB of traffic for the Trial Period;
  5. public IPv4 address: 1;
  6. backups: 2;
  7. snapshots: 1;
  8. available operating system images;
  9. the ability to deploy applications from the Servermall Cloud application store.

2.8. The configuration of Test Resources, limits and number of included additional capabilities are not increased at the initiative of the User as part of Test Access. Changing the configuration, expanding limits or adding resources beyond the parameters of the Programme is possible only upon early transition to paid use, if such transition is confirmed by the User and approved by Servermall Cloud.

2.9. Test Access is provided on condition that at least one Payment Method is linked to the User Account and verified throughout the Trial Period. For Payment Method Verification, a verification transaction is carried out in the amount and in the manner established by the Agreement. Such verification transaction is not Payment for a Paid Subscription or a fee for Test Access.

3. Special VDS Use Scenarios

3.1. In addition to the general permitted purposes established by the Trial Policy, as part of the Programme the User may use Test Resources for the following VDS scenarios within the configuration and limits of the Test Resources:

  1. familiarisation with the Servermall Cloud “Virtual Machines” Service management interfaces and typical operations for managing a virtual server instance;
  2. deployment and review of available operating system images;
  3. deployment of applications from the Servermall Cloud application store;
  4. training in OS administration and configuration in a test environment;
  5. deployment of test, demonstration and pilot web interfaces and APIs using the public IPv4 address provided as part of the Programme;
  6. checking the operation of backups and snapshots within the included quantity;
  7. integration testing with external test or non-production systems, including webhooks, OAuth/OIDC, external APIs, repositories and container registries;
  8. basic performance measurements of the User’s own test and pilot environments within the allocated vCPU, configuration, limits and restrictions established by the Trial Policy.

3.2. As part of the Programme, Test Resources must not be used for resale, sublicensing, transfer to third parties as a standalone paid infrastructure service, managed service, outsourcing or other independent commercial provision of Test Resources, or for processing sensitive or regulated data and other purposes prohibited by the Trial Policy, the Agreement and applicable Servermall Cloud documents.

3.3. With respect to the Programme, full production operation of Test Resources is permitted within the configuration, limits, Trial Period and other restrictions established by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents. Such use of Test Resources in the User’s own production processes does not constitute the monetisation of Test Resources that is prohibited by clause 3.2.

3.4. Load testing, stress tests, mass generation of network traffic, long-term tests of maximum resource utilisation and public comparative testing are permitted only with prior written approval from Servermall Cloud and within the agreed parameters.

4. Participant Requirements and Activation Procedure

4.1. A User may participate in the Programme if the User meets the requirements of the Trial Policy and has not previously received Test Access under this or any other Servermall Cloud Trial Programme, and has not previously used Servermall Cloud Services through the same Account, the same organisation or other indicators that Servermall Cloud is entitled to take into account in accordance with the Trial Policy, unless Servermall Cloud has agreed otherwise.

4.2. To activate the Programme, the User must meet the general requirements of the Trial Policy, perform the actions set out in the instruction “How to Activate the 30-Day Freetest VDS Program“, and perform the actions in the Servermall Cloud interface, including acceptance of the Agreement, the Trial Policy, this Special Trial Policy, linking and Verification of a Payment Method, and giving consent to automatic transition of Transitioning Resources to paid use and charging of Payment unless the User submits an Opt-Out.

4.3. After the activation conditions are fulfilled, successful Verification of the Payment Method is completed and Servermall Cloud approves the Account and the User, the following consequences occur:

  1. the Servermall Cloud accounting system reflects a purpose-specific Bonus in the User’s Account Balance for use as part of the Programme;
  2. the Servermall Cloud accounting system debits the Bonus to cover, for accounting purposes, the fixed configuration and limits of the Test Resources as part of the Programme; such debiting does not constitute the User making Payment;
  3. a virtual server instance with the configuration and limits established by this Special Trial Policy is deployed for the User;
  4. in the “Products & Services” section of the Servermall Cloud service control panel, the User is given access to manage the “Virtual Machines” product;
  5. the User receives the status of a participant in the “30-Day Freetest VDS” Programme.

5. Completion of the Programme and Paid Continuation

5.1. The Programme provides for automatic transition of Transitioning Resources to paid use after the end of the Trial Period, if Servermall Cloud has not received an Opt-Out before the end of the Trial Period in the manner established by the Trial Policy and this Special Trial Policy.

5.2. Transitioning Resources are resources of the virtual server instance that have been created and not deleted at the time when the Trial Period ends, including the virtual server instance itself, disk, public IPv4 address, related backups, snapshots, configurations and data, if their retention is technically possible. Unused traffic limits and unused capabilities for creating backups or snapshots are not Transitioning Resources, unless expressly agreed otherwise with Servermall Cloud.

5.3. If Servermall Cloud has not received an Opt-Out before the end of the Trial Period, the Transitioning Resources continue to operate on a paid basis under a Paid Subscription to the Servermall Cloud “Virtual Machines” Service.

5.4. The Paid Subscription is created with the following parameters:

  1. the scope of paid use is determined by the Transitioning Resources at the time of transition, and the configuration and limits of the Service are set at the level necessary to retain those Transitioning Resources, unless otherwise agreed by the Parties;
  2. the unit cost of resources and accrual procedure are determined by the current tariffs and the Agreement, unless otherwise agreed by the Parties;
  3. the billing period is set at 1 month, unless otherwise agreed by the Parties;
  4. the virtual server instance, data, configurations, network parameters, backups, snapshots, account and authentication access credentials are retained as they existed at the time of transition to paid service, if this is technically possible and does not breach applicable Servermall Cloud documents;
  5. funds to pay for the Paid Subscription are debited from the available monetary portion of the Account Balance, if such amount exists and may be used to make Payment; if such amount is insufficient, Payment is debited from the Payment Method linked to the User Account;
  6. the Bonus received as part of the Programme is not included in the available monetary portion of the Account Balance and may not be used to pay for the Paid Subscription.

5.5. No later than 2 calendar days before the end of the Trial Period, Servermall Cloud sends the User notice of the upcoming end of the Trial Period, the composition of the Transitioning Resources, the possible consequences of completion, the estimated cost of paid use and the available ways to refuse paid continuation. Such notice is sent with the content, through the channels and with the consequences provided by the Trial Policy.

5.6. Early transition to a Paid Subscription is permitted before the end of the Trial Period if the User submits a ticket through the Servermall Cloud service control panel and Servermall Cloud confirms the transition. Conversion of Transitioning Resources to paid service is deemed completed from the moment of proper payment for the Paid Subscription and in the absence of refusal by Servermall Cloud to create such Paid Subscription, unless Servermall Cloud has expressly agreed another procedure. From that moment, Test Access is deemed ended early, and further use of the resources is governed by the Agreement, applicable appendices and the terms of the Paid Subscription.

5.7. The consequences of Opt-Out, non-payment for the Paid Subscription, unlinking of the mandatory Payment Method, late payment, suspension and termination of participation are determined by the Trial Policy.
