1. Purpose of the Document and Applicable Terms
1.1. This document “30-Day Freetest IaaS – Special Trial Policy” (the “Special Trial Policy”) establishes the parameters and unique terms of the Trial Programme “30-Day Freetest IaaS” (the “Programme”) provided by UAB ServerMall and its affiliates acting under the designation “Servermall Cloud” (collectively, “Servermall Cloud”).
1.2. This Programme is a Trial Programme within the meaning of the “Servermall Cloud Trial Policy” (the “Trial Policy”). This Special Trial Policy sets out details of the Trial Policy as it applies to this Programme.
1.3. This Special Trial Policy applies subject to the order of contractual priority established by the Trial Policy. In the event of conflicts between this Special Trial Policy and the Trial Policy with respect to the parameters and procedure for providing this Programme, this Special Trial Policy applies, unless the Individual Trial Programme Agreement, the applicable Contract or mandatory requirements of applicable law provide otherwise. To the extent not regulated by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents apply.
1.4. Descriptions of this Programme in instructions, on the Site, in the interface, in tips, banners, the “Questions and Answers” section, advertising and other informational materials do not amend this Special Trial Policy, the Trial Policy or the Agreement and are not an Individual Trial Programme Agreement, unless they expressly show the Parties’ agreed intention to amend the terms of this Programme. In the event of a conflict, the applicable contractual documents have priority in the order established by the Trial Policy.
1.5. The requirements of the Acceptable Use Policy, No Spam Policy, Intellectual Property Policy and other applicable Servermall Cloud documents must be complied with in all cases. If this Special Trial Policy provides requirements that are less strict than those documents, the stricter requirements apply, unless mandatory requirements of applicable law provide otherwise.
2. Main Parameters of this Programme
2.1. This Programme is provided at the discretion of Servermall Cloud and is intended for evaluating the “Cloud Infrastructure” Service.
2.2. Under this Programme, Servermall Cloud provides the User with Test Access to the “Cloud Infrastructure” Service.
2.3. Test Access is provided for a Trial Period of 30 calendar days. The Trial Period is calculated from the date and time of actual deployment of the test project recorded in the Servermall Cloud accounting system and ends after 30 calendar days on the corresponding date and time according to Servermall Cloud billing time. If a different time is displayed to the User in the Servermall Cloud interface, the data in the Servermall Cloud accounting system has priority, unless mandatory requirements of applicable law provide otherwise.
2.4. As part of Test Access, the User is provided with:
- an individual project in the Servermall Cloud cloud infrastructure with the quotas established by this Special Trial Policy;
- a project control panel in the Servermall Cloud cloud infrastructure (GUI);
- a command-line interface for managing the Servermall Cloud cloud infrastructure (CLI);
- access to the control panel for the Servermall Cloud “Cloud Infrastructure” Service.
2.5. For the purposes of this Programme, Servermall Cloud records in the Servermall Cloud accounting system (billing) a promotional credit with a nominal value of EUR 222 in relation to the User’s Account (the “Bonus”). The Bonus is a conditional accounting value and is used solely for accounting coverage of the fixed resource quota configuration under this Programme. Recording or debiting the Bonus does not constitute the User making Payment, adding monetary funds to the Account Balance, payment for a Paid Subscription, or grounds for a refund, payout, withdrawal of funds or compensation. The Bonus cannot be used for other Services, quota expansion, payment for a Paid Subscription after the end of Test Access, or withdrawal of funds.
2.6. The Bonus may not be withdrawn, and any other use of the Bonus not provided for by this Special Trial Policy is prohibited.
2.7. Resource quota configuration for Test Access:
- 14 virtual CPUs;
- 46 GB RAM;
- 290 GB hybrid storage (SSD+HDD);
- 190 GB All-Flash Storage (SSD);
- backup volume: 290 GB;
- floating IP addresses: 2.
2.8. Resource quotas are not increased at the User’s initiative within Test Access. Quota expansion is possible only upon early transition to paid service, if such transition is confirmed by the User and approved by Servermall Cloud.
2.9. Test Access is provided on condition that at least one Payment Method is linked to the User’s Account and remains verified throughout the Trial Period.
3. Special IaaS Use Scenarios
3.1. In addition to the general permitted purposes established by the Trial Policy, under this Programme the User may use Test Resources for the following IaaS scenarios within the allocated quotas:
- familiarisation with the Servermall Cloud cloud infrastructure management interfaces and standard project management operations;
- deploying and studying operating system images, standard software stacks and templates available in the Servermall Cloud cloud infrastructure;
- training in OS administration and configuration in a test environment;
- configuring test network parameters, filtering rules, security groups, access policies, logging and monitoring, if the relevant mechanisms are available in the project;
- deploying test, demonstration and pilot web interfaces and APIs using floating IP addresses;
- integration testing with external test or non-production systems, including webhooks, OAuth/OIDC, external APIs, repositories and container registries;
- basic performance measurements of the User’s own test and pilot environments within the allocated quotas and restrictions established by the Trial Policy.
3.2. Under this Programme, Test Resources must not be used for resale, sublicensing, transfer to third parties as a standalone paid infrastructure service, managed service, outsourcing or other standalone commercial provision of Test Resources, or for processing sensitive or regulated data, or for other purposes prohibited by the Trial Policy, the Agreement and applicable Servermall Cloud documents.
3.3. With respect to this Programme, full production operation of Test Resources is permitted within the allocated quotas, the Trial Period and other restrictions established by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents. Such use of Test Resources in the User’s own production processes is not considered the monetisation of Test Resources prohibited by clause 3.2.
3.4. Load testing, stress tests, mass generation of network traffic, long-term tests of maximum resource utilisation and public comparative testing are permitted only with prior written approval from Servermall Cloud and within the agreed parameters.
4. Participant Requirements and Activation Procedure
4.1. A User may participate in this Programme if the User meets the requirements of the Trial Policy and has not previously received Test Access under this or any other Servermall Cloud Trial Programme, and has not previously used Servermall Cloud Services through the same Account, the same organisation or other indicators that Servermall Cloud may take into account in accordance with the Trial Policy, unless otherwise agreed by Servermall Cloud.
4.2. To activate this Programme, the User must meet the general requirements of the Trial Policy, complete the actions set out in the instruction “How to Activate the 30-Day Freetest IaaS Programme” and complete the actions required in the Servermall Cloud interface, including acceptance of the Agreement, the Trial Policy, this Special Trial Policy, linking and verification of a Payment Method, and consent to automatic transition of Transitioning Resources to paid use and charging of Payment if the User does not submit an Opt-Out.
4.3. After the activation conditions are fulfilled and the Account and User are approved by Servermall Cloud, the following consequences take effect:
- the Servermall Cloud accounting system records a purpose-specific Bonus in the User’s Account Balance for use under this Programme;
- the Servermall Cloud accounting system debits the Bonus for accounting coverage of the fixed resource quota configuration under this Programme; such debiting does not constitute the User making Payment;
- an individual project in the Servermall Cloud cloud infrastructure with the quotas established by this Special Trial Policy is deployed for the User;
- in the “Products & Services” section of the Servermall Cloud service control panel, the User is given access to manage the “Cloud Infrastructure” Service;
- the User receives the status of a participant in the “30-Day Freetest IaaS” Programme.
5. Completion of this Programme and Paid Continuation
5.1. This Programme provides for automatic transition of Transitioning Resources to paid use after the end of the Trial Period if Servermall Cloud has not received an Opt-Out before the end of the Trial Period in the manner established by the Trial Policy and this Special Trial Policy.
5.2. Transitioning Resources are project resources created and not deleted at the time the Trial Period ends, including virtual machines, volumes, floating IP addresses, related configurations and data, as well as the project itself, if its retention is technically possible. Unused quotas, an unused Bonus and rights to quota expansion are not Transitioning Resources unless otherwise expressly agreed with Servermall Cloud.
5.3. If Servermall Cloud has not received an Opt-Out before the end of the Trial Period, the Transitioning Resources continue to operate on a paid basis under a Paid Subscription to the “Cloud Infrastructure” Service.
5.4. The Paid Subscription is created with the following parameters:
- the scope of paid use is determined by the Transitioning Resources at the time of transition, and the project quotas are set at the level required to retain such Transitioning Resources, unless otherwise agreed by the Parties;
- the unit cost of resources and the accrual procedure are determined by the current tariffs and the Agreement, unless otherwise agreed by the Parties;
- the billing period is set at 1 month, unless otherwise agreed by the Parties;
- the project, data, account details and authentication credentials for accessing the Servermall Cloud cloud infrastructure are retained as they existed at the time of transition to paid service, if technically possible and if this does not breach applicable Servermall Cloud documents;
- funds to pay for the Paid Subscription are debited from the available monetary portion of the Account Balance, if such amount exists and may be used to make Payment; if such amount is insufficient, Payment is debited from the Payment Method linked to the User’s Account;
- the Bonus received under this Programme is not included in the available monetary portion of the Account Balance and may not be used to pay for the Paid Subscription.
5.5. No later than 2 calendar days before the end of the Trial Period, Servermall Cloud sends the User notice of the upcoming end of the Trial Period, the composition of the Transitioning Resources, the possible consequences of completion, the estimated cost of paid use and the available ways to refuse paid continuation. The content of such notice, the channels for sending it and its consequences are governed by the Trial Policy.
5.6. Early transition to a Paid Subscription before the end of the Trial Period is permitted if the User submits a ticket through the Servermall Cloud service control panel and Servermall Cloud confirms the transition. Conversion of Transitioning Resources to paid service is deemed completed from the moment of proper payment for the Paid Subscription and in the absence of refusal by Servermall Cloud to create such Paid Subscription, unless Servermall Cloud has expressly agreed another procedure. From that moment, Test Access is deemed ended early, and further use of the resources is governed by the Agreement, applicable appendices and the terms of the Paid Subscription.
5.7. The consequences of Opt-Out, failure to pay for the Paid Subscription, unlinking of the mandatory Payment Method, late payment, suspension and termination of participation are determined by the Trial Policy.
