1. Purpose of the Document and Applicable Terms

1.1. This document “30-Day Freetest IaaS No-Card – Special Trial Policy” (the “Special Trial Policy”) establishes the parameters and unique terms of the Trial Programme “30-Day Freetest IaaS No-Card” (the “Programme”), provided by UAB ServerMall and its affiliates operating under the “Servermall Cloud” designation (collectively, “Servermall Cloud”).

1.2. This Programme is a Trial Programme within the meaning of “Servermall Cloud Trial Policy” (the “Trial Policy”). This Special Trial Policy specifies how the Trial Policy applies to this Programme.

1.3. This Special Trial Policy applies subject to the order of contractual priority established by the Trial Policy. In the event of conflicts between this Special Trial Policy and the Trial Policy with respect to the parameters and procedure for providing this Programme, this Special Trial Policy applies, unless the Individual Trial Programme Agreement, the applicable Contract or mandatory requirements of applicable law provide otherwise. To the extent not regulated by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents apply.

1.4. Descriptions of this Programme in instructions, on the Site, in the interface, in tooltips, banners, the “Questions and Answers” section, and in advertising and other informational materials do not amend this Special Trial Policy, the Trial Policy or the Agreement and are not an Individual Trial Programme Agreement, unless they expressly show the agreed intention of the Parties to amend the terms of this Programme. In the event of a conflict, the applicable contractual documents have priority in the order established by the Trial Policy.

1.5. The requirements of the Acceptable Use Policy, No Spam Policy, Intellectual Property Policy and other applicable Servermall Cloud documents must be complied with in all cases. If this Special Trial Policy provides requirements that are less strict than those documents, the stricter requirements apply, unless mandatory requirements of applicable law provide otherwise.

2. Main Parameters of This Programme

2.1. This Programme is provided at the discretion of Servermall Cloud and is intended for evaluation of the “Cloud Infrastructure” Service.

2.2. Under this Programme, Servermall Cloud provides the User with Test Access to the “Cloud Infrastructure” Service.

2.3. Test Access is provided for 30 calendar days. The term is calculated from the date and time of actual deployment of the test project recorded in the Servermall Cloud accounting system and ends after 30 calendar days on the corresponding date and at the corresponding time according to Servermall Cloud billing time. If another time is shown to the User in the Servermall Cloud interface, the data in the Servermall Cloud accounting system has priority, unless mandatory requirements of applicable law provide otherwise.

2.4. As part of Test Access, the User is provided with:

  1. an individual project in the Servermall Cloud cloud infrastructure with the configuration and limits of Test Resources established by this Special Trial Policy;
  2. a project control panel in the Servermall Cloud cloud infrastructure (GUI);
  3. a command-line interface for managing the Servermall Cloud cloud infrastructure (CLI);
  4. access to the control panel for the Servermall Cloud “Cloud Infrastructure” Service.

2.5. For the purposes of implementing this Programme, Servermall Cloud records a Promotional Credit in the Servermall Cloud accounting system (billing) in relation to the User Account, with a nominal value determined by Servermall Cloud as the estimated cost of 30 calendar days of use of the configuration and limits of Test Resources specified in clause 2.7 of this Special Trial Policy (the “Bonus”). The Bonus is a conditional accounting value and is used exclusively to cover, for accounting purposes, the fixed configuration and limits of Test Resources under this Programme. The recording or debiting of the Bonus does not constitute the making of Payment by the User, crediting the Account Balance with monetary funds, payment for a Paid Subscription or a basis for a refund, payout, withdrawal or compensation. The Bonus may not be used for other Services, changing the configuration, expanding limits, paying for a Paid Subscription after completion of Test Access or withdrawing funds.

2.6. Withdrawal of the Bonus and any other use of the Bonus not provided by this Special Trial Policy are prohibited.

2.7. Configuration and limits of Test Resources for Test Access:

  1. 1 virtual processor;
  2. 2 GB RAM;
  3. 10 GB All-Flash Storage (SSD);
  4. hybrid SSD+HDD storage – not provided;
  5. backup volume – not provided;
  6. external IP addresses, including floating IP addresses and public IP addresses – not provided.

2.8. The configuration of Test Resources, limits and the number of included capabilities may not be changed or increased at the initiative of the User as part of Test Access. Automatic or early transition to paid use of Test Resources, the project, configurations, data, account and authentication access credentials created under this Programme is not provided for. Use of paid Servermall Cloud Services is possible only on the basis of a separate order or separate Paid Subscription outside this Programme, if such order or Subscription is accepted by Servermall Cloud.

2.9. Linking and Verification of a Payment Method are not mandatory conditions for providing Test Access under this Programme.

3. Special IaaS Use Scenarios

3.1. In addition to the general permitted purposes established by the Trial Policy, under this Programme the User may use Test Resources for the following IaaS scenarios within the configuration and limits of Test Resources:

  1. familiarisation with Servermall Cloud cloud infrastructure management interfaces and standard project management operations;
  2. deployment and study of operating system images, standard software stacks and templates available in the Servermall Cloud cloud infrastructure;
  3. training in OS administration and configuration in a test environment;
  4. configuration of test network parameters, filtering rules, security groups, access policies, logging and monitoring, if the relevant mechanisms are available in the project;
  5. deployment of test, demonstration and pilot web interfaces and APIs without provision of an external IP address, with access only through available internal network mechanisms of the project, the project console or other access tools, if such tools are technically available in the Servermall Cloud cloud infrastructure;
  6. basic performance measurements of User-owned test and pilot environments within the configuration, limits and restrictions established by the Trial Policy.

3.2. Under this Programme, Test Resources must not be used for resale, sublicensing, providing Test Resources to third parties as a standalone paid infrastructure service, a managed service, an outsourcing service or another standalone commercial provision of Test Resources, or for processing sensitive or regulated data and other purposes prohibited by the Trial Policy, the Agreement and applicable Servermall Cloud documents.

3.3. Production operation of Test Resources under this Programme is not permitted. This Programme is intended for familiarisation, training, testing, demonstration and pilot scenarios within the configuration and limits of Test Resources, the Trial Period and other restrictions established by this Special Trial Policy, the Trial Policy, the Agreement and other applicable Servermall Cloud documents.

3.4. Load testing, stress tests, mass generation of network traffic, long-term tests of maximum resource utilisation and public comparative testing are permitted only with prior written approval from Servermall Cloud and within the agreed parameters.

4. Participant Requirements and Activation Procedure

4.1. A User may participate in this Programme if the User meets the requirements of the Trial Policy and has not previously received Test Access under this or any other Servermall Cloud Trial Programme, and has not previously used Servermall Cloud Services through the same Account, on behalf of the same organisation or in circumstances involving other indicators that Servermall Cloud may take into account in accordance with the Trial Policy, unless otherwise agreed by Servermall Cloud.

4.2. To activate this Programme, the User must fulfil the general requirements of the Trial Policy and complete the actions set out in the instruction “How to Activate the 30-Day Freetest IaaS No-Card Program” and in the Servermall Cloud interface, including acceptance of the Agreement, the Trial Policy and this Special Trial Policy. Linking and Verification of a Payment Method, and consent to automatic transition of Test Resources to paid use and charging of Payment, are not required.

4.3. After the activation conditions are fulfilled and Servermall Cloud approves the Account and the User, the following consequences apply:

the Servermall Cloud accounting system records in relation to the User Account a purpose-specific Bonus for use under this Programme;

  1. the Servermall Cloud accounting system debits the Bonus to cover, for accounting purposes, the fixed configuration and limits of Test Resources under this Programme; such recording and debiting do not constitute the making of Payment by the User, crediting the Account Balance with monetary funds or payment for a Paid Subscription;
  2. an individual project is deployed for the User in the Servermall Cloud cloud infrastructure with the configuration and limits of Test Resources established by this Special Trial Policy;
  3. in the “Products & Services” section of the Servermall Cloud service control panel, the User receives access to manage the “Cloud Infrastructure” product;
  4. the User receives the status of a participant in the “30-Day Freetest IaaS No-Card” Programme.

4.4. By activating this Programme, the User confirms that after the end of the Trial Period the project, Test Resources, configurations and data will be automatically deleted in the manner established by this Special Trial Policy.

5. Completion of This Programme and Automatic Project Deletion

5.1. This Programme does not provide for automatic transition of Test Resources, the project, configurations, data, account and authentication access credentials to paid use after the end of the Trial Period, or their early transition to paid use before the end of the Trial Period. Upon expiry of the Trial Period, Test Access ends, and the project and related resources are subject to automatic deletion in the manner established by this Special Trial Policy.

5.2. Deletable Resources are all resources created for or within the project of this Programme, including virtual machines, volumes, images, snapshots, internal network settings, filtering rules, security groups, account and authentication access credentials, configurations, logs, data and the project itself.

5.3. Upon expiry of the Trial Period, Servermall Cloud terminates Test Access and automatically deletes the Deletable Resources without additional confirmation from the User and without the need for the User to submit an Opt-Out. The User must independently export, copy or delete required data before the end of the Trial Period. After deletion of the project, restoration of resources, configurations and data is not guaranteed.

5.4. No Paid Subscription is created upon completion of this Programme. Servermall Cloud does not charge Payment for continued use of Test Resources after the end of the Trial Period, does not debit Payment for such resources from the Account Balance and does not use the Payment Method of the User to pay for continuation of this Programme. Paid Servermall Cloud Services may be ordered only on the basis of a separate order or separate Paid Subscription outside this Programme, if such order or Subscription is accepted by Servermall Cloud.

5.5. No later than 2 calendar days before the end of the Trial Period, Servermall Cloud sends the User a notice of the upcoming end of the Trial Period, termination of Test Access and upcoming automatic deletion of the project, Test Resources, configurations and data. This notice is sent with the content and through the channels provided by the Trial Policy and has the consequences provided by the Trial Policy, unless mandatory requirements of applicable law provide otherwise.

5.6. Early transition to paid use of Test Resources, the project, configurations and data created under this Programme is not permitted. The User may terminate participation in this Programme early by deleting resources or submitting a request to Servermall Cloud support, if such procedure is available in the Servermall Cloud service control panel. Creation of a Paid Subscription for the “Cloud Infrastructure” Service is possible only separately from this Programme and does not create an obligation for Servermall Cloud to preserve, transfer or restore resources created under this Programme, unless Servermall Cloud has expressly agreed otherwise.

5.7. The consequences of early termination of participation, suspension of Test Access, breach by the User of this Special Trial Policy, the Trial Policy, the Agreement or other applicable Servermall Cloud documents, and the consequences of deletion of the project and Test Resources, are determined by the Trial Policy, this Special Trial Policy and applicable Servermall Cloud documents.
